¿Por qué esta condición es contraria a la ley?
Obligar al inquilino a firmar un contrato de temporada (frecuentemente estipulado en 11 meses) cuando el inmueble va a ser destinado a su residencia habitual permanente constituye un fraude de ley manifiesto tipificado en el artículo 6.4 del Código Civil y una vulneración frontal del artículo 9 de la LAU.
La jurisprudencia del Tribunal Supremo es unánime: la naturaleza del contrato de arrendamiento viene determinada por el uso y destino real de la vivienda, no por el nombre o duración que le otorgue el arrendador o la agencia. Para que un contrato de temporada sea válido debe concurrir, acreditarse y documentarse una causa real y justificada de temporalidad (por ejemplo: estancia académica en otra localidad o desplazamiento laboral justificado con fecha de retorno).
Si no concurre dicha causa, el arrendatario tiene pleno derecho a acogerse a las prórrogas forzosas obligatorias que garantiza la LAU: hasta 5 años si el arrendador es persona física, o hasta 7 años si es persona jurídica o fondo inmobiliario.
